1. Who these terms are between

These terms are an agreement between [COMPANY LEGAL NAME], trading as OrganicTraffic, registered at [REGISTERED ADDRESS] (“we”, “us”), and the person or organisation purchasing a data file (“you”). By placing an order you accept them.

2. What we provide

We compile and supply files of business contact information — business names, publicly published email addresses and phone numbers, websites, trading addresses, public review ratings and related business attributes — for the industry and geography you select at checkout.

Files are built to order. Data is collected and verified after your payment clears, not served from a pre-existing stored dataset. This is why delivery takes hours rather than being instant.

We supply business contact information only. We do not supply consumer data, residential addresses, personal mobile numbers, or information about individuals acting in a private capacity.

3. Orders, pricing and payment

• Prices are shown in US dollars on every product page and are calculated from two factors: targeting specificity and batch size. The price you see is the price you pay.
• Orders start at $49 for 250 country-wide records. The minimum batch size is 250 records.
• Payment is taken in full at checkout by our payment processor. We never see or store your card details.
• Sales tax, VAT or GST is applied at checkout based on the country you select. You are responsible for giving us the correct country.
• There is no subscription, no recurring charge, no minimum term and no credit balance.

4. Delivery

Standard delivery is within 24 hours of successful payment. With the Rush Delivery add-on it is within 4 hours. Files are delivered by email as a download link containing both CSV and XLSX formats. Download links remain active for 30 days; we will re-issue an expired link on request at no charge.

If we deliver outside the applicable window, you are entitled to a full refund and you keep the file.

5. The accuracy guarantee

We guarantee that at least 95% of email addresses in a delivered file are deliverable, measured by hard bounces recorded within 14 days of delivery.

To claim, email us the bounce log exported from your sending tool within 14 days of delivery. If the hard-bounce rate exceeds 5%, we will at your choice either re-run the batch at no charge or refund the order in full.

The guarantee covers hard bounces only. It does not cover soft bounces, spam-folder placement, deliverability problems caused by your sending domain or infrastructure, or recipients declining to engage — none of which are a function of the data.

6. Record shortfalls

If your chosen slice contains fewer qualifying records than you ordered, we will tell you before delivery and automatically refund the difference at the per-record price you paid. We will never pad a file with records that fall outside your specification in order to reach a count.

7. Your licence to the data

On payment you receive a perpetual, worldwide, non-exclusive, non-transferable licence to use the delivered data for your own business purposes, including contacting the businesses listed, importing it into your CRM or sending tools, and enriching it with your own data.

You may not:

• resell, sublicense, publish or otherwise redistribute the raw data or any substantial part of it;
• incorporate it into a product or dataset that you then sell or license to others;
• share it with a third party other than a contractor acting on your behalf and bound by equivalent restrictions;
• use it in any way that breaches our Acceptable Use Policy.

Delivery of a file is not exclusive unless you have separately purchased exclusivity. We do, however, cap how many times any single industry-and-location slice is delivered within a rolling 30-day window.

8. Your obligations

You are the data controller in respect of the delivered data from the moment it reaches you. You are responsible for complying with all laws applicable to how you use it, including electronic-marketing and data-protection law in your jurisdiction and in the jurisdiction of each recipient. 9. Refunds and cancellation

Our full Refund Policy forms part of these terms. In summary: a full refund is available before we begin building your file, and after delivery where the guarantee, the record count or the delivery window has been missed. Because files are custom-built to your specification, a correctly delivered file that meets spec is not refundable simply because you changed your mind.

10. Warranties and limits

We warrant that we compile data using reasonable skill and care from sources that are lawfully accessible, and that we apply the verification steps described on our data quality page.

We do not warrant that data is complete, error-free, or that any particular business remains contactable — businesses close, change hands and change details continuously. Beyond the guarantees expressly set out in these terms, the data is provided as is.

Our total liability arising out of or in connection with any order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, including lost profits, lost business, or damage to sender reputation. Nothing in these terms excludes liability that cannot lawfully be excluded.

11. Changes to these terms

We may update these terms. The version in force for your order is the version published at the moment you paid. Material changes are reflected in the “last updated” date above.

12. Governing law

These terms are governed by the laws of [JURISDICTION], and the courts of [JURISDICTION] have exclusive jurisdiction, without prejudice to any mandatory consumer rights you have where you live.
